It requires the plastic part of packaging to contain a minimum percentage of post-consumer recycled plastic from 2030, with higher targets in 2040. For non-PET food-contact packaging, mechanical recycling cannot currently supply suitable material, and that is where chemical recycling through pyrolysis becomes essential.

What the PPWR is: the EU packaging regulation

PPWR stands for Packaging and Packaging Waste Regulation. Its official name is Regulation (EU) 2025/40 of the European Parliament and of the Council of 19 December 2024 on packaging and packaging waste.

Publication: Official Journal of the EU of 22 January 2025.

Entry into force: 11 February 2025.

General application: from 12 August 2026, although many obligations have later dates.

What it replaces: it repeals Packaging Directive 94/62/EC (some of its provisions continue to apply on a transitional basis) and amends Directive (EU) 2019/904 on single-use plastics.

Relationship with Spain’s packaging law

In Spain, the so-called “packaging law” is Royal Decree 1055/2022 of 27 December on packaging and packaging waste. According to a clarifying note issued by MITECO (Spain’s Ministry for the Ecological Transition) in May 2026, the PPWR prevails over any incompatible national rule; the Royal Decree continues to apply wherever the regulation does not cover or contradict it. The Ministry is preparing a new royal decree on packaging to bring the Spanish framework into line, and its prior public consultation ran from May to June 2025.

Recycled content targets for plastic packaging in 2030 and 2040

Article 7 of the PPWR sets the minimum percentage of recycled content recovered from post-consumer plastic waste in the plastic part of packaging. It depends on whether the packaging is “contact-sensitive” (for example, for food) and whether its main polymer is PET.

Type of plastic packaging

2030

2040

Contact-sensitive, made from PET (except single-use beverage bottles)

30 %

50 %

Contact-sensitive, made from other plastics (except single-use beverage bottles)

10 %

25 %

Single-use plastic beverage bottles

30 %

65 %

Other plastic packaging

35 %

65 %

The 2030 targets apply from 1 January 2030 or three years after the entry into force of the implementing act on the calculation methodology, whichever is later. The 2040 targets apply from 1 January 2040.

How it is calculated: per manufacturing plant and year

The percentage is not required packaging item by packaging item. It is an average per manufacturing plant and year, by packaging type and format, and it is demonstrated in the technical documentation. In addition, recycled material only counts if the waste was collected in the EU (or in third countries with equivalent standards) and recycled in facilities with environmental standards comparable to European ones.

Pending acts and their status

The regulation tasks the European Commission with three pieces of secondary legislation, with a deadline of 31 December 2026:

Article 7(8) (implementing act): the method for calculating and verifying recycled content. In preparing it, the Commission must assess the available recycling technologies on their economic and environmental performance.

Article 7(9) (delegated act): sustainability criteria for plastic recycling technologies. Only recycling carried out with technologies that meet them will count.

Article 7(10) (implementing act): verification of equivalent standards when recycling takes place outside the EU.

As of October 2026, none has been adopted. In August the Commission opened a call for evidence, which closed on 16 September, and it is still aiming to adopt them by the end of the year.

There are exemptions: food-contact packaging where recycled content poses a health risk and prevents compliance with Regulation (EC) 1935/2004, a plastic part of less than 5 % of the packaging’s weight, and certain packaging for medicines and medical devices. Before 1 January 2028, the Commission will assess whether further exemptions are needed, in particular for the 10 % target.

Other obligations in the packaging regulation that affect plastic

Recyclability grades: from 2030 (or 24 months after the design-for-recycling acts, if later) only packaging graded A, B or C may be placed on the market; from 2038, only A or B.

Reduction: packaging waste per capita must fall by 5 % by 2030, 10 % by 2035 and 15 % by 2040 compared with 2018.

Reuse: mandatory 2030 targets for transport and sales packaging (40 %) and grouped packaging (10 %), plus targets for beverages.

Restricted formats: from 2030 the bans include plastic grouped packaging used for convenience, plastic for fresh fruit and vegetables in quantities under 1.5 kg (with exemptions) and single portions in the hospitality sector.

Harmonised labelling: a common material composition label from 12 August 2028, or 24 months after its implementing act.

PFAS: from 12 August 2026, food-contact packaging may not exceed 25 ppb of any single PFAS, 250 ppb of their sum or 50 ppm of total PFAS.

Why mechanical recycling is not enough for food-contact packaging

Mechanical recycling shreds, washes and remelts plastic without changing its chemical structure. For food packaging it runs up against a regulatory limit.

That use is governed by Regulation (EU) 2022/1616. Today the technologies authorised as suitable are mechanical recycling of post-consumer PET and recycling from closed and controlled product loops. For post-consumer polyethylene, polypropylene or polystyrene there is no authorised mechanical technology.

The upshot: PET can comply through mechanical recycling, but food-packaging polyolefins (films, tubs, trays) will struggle to reach the 10 % for 2030 and the 25 % for 2040 that way. We go into more detail in how chemical recycling differs from mechanical recycling.

What chemical recycling brings

Plastic waste pyrolysis breaks the polymer chains and returns plastic to hydrocarbons. Pyrolysis oil enters the petrochemical industry as a feedstock, and from it come new polymers of a quality equivalent to virgin plastic. Full chemical recycling back to starting substances falls outside Regulation 2022/1616 and is governed by the general rules on plastics in contact with food. Pyrolysis also accepts the mixed, dirty or multilayer plastic that mechanical recycling rejects.

Chemical recycling and mass balance: what the PPWR does (and does not) say

The text of the PPWR does not expressly mention chemical recycling or mass balance. It is technology-neutral and leaves to the Article 7(8) and 7(9) acts how recycled content is calculated and which technologies count. Until they are adopted, two questions remain open: which sustainability criteria chemical recycling will have to meet, and how recycled content will be attributed when pyrolysis oil is mixed with fossil feedstock in the petrochemical plant, which is what mass balance resolves.

There is a reference point. On 30 June 2026, under the single-use plastics directive, the Commission adopted an implementing decision on calculating the recycled content of PET beverage bottles. It accepts mass balance with the fuel-use excluded method: material that ends up being burned does not count. It applies only to those bottles, although the Commission states that it must assess its alignment with the future PPWR act.

Today, traceability of chemically recycled material is demonstrated through schemes such as ISCC PLUS: ISCC PLUS and environmental credits.

What the PPWR means for companies in Spain

Packaging manufacturers and brands: they must secure a supply of suitable recycled plastic. For non-PET food-contact packaging, that means chemical recycling. As the target is per plant and year, it makes sense to plan now which product lines will carry more recycled content and to sign contracts with certified traceability.

Waste managers, landfills and public authorities: mixed plastic and the rejects from sorting plants become a feedstock in demand. We review the state of the sector in chemical recycling in Spain.

Timeline of key deadlines

12 August 2026: general application and PFAS limits.

31 December 2026: deadline for the acts on calculation and sustainability criteria for recycled content.

1 January 2028: design-for-recycling acts and review of exemptions.

12 August 2028: harmonised labelling (or 24 months after its implementing act).

1 January 2029: calculation and verification must follow the implementing act (or 24 months after its entry into force).

1 January 2030: recycled content targets (or three years after the calculation act), grades A-C and format restrictions.

1 January 2040: 2040 recycled content targets.

Where Nantek fits in

Since 2022 Nantek has operated an industrial plant at the Port of Bilbao, where it has validated its technology with plastics from a range of sources. Its process is catalyst-free thermal pyrolysis, using proprietary reactive agents, and it accepts mixed plastic without prior sorting: the fraction that mechanical recycling cannot use.

It offers modular plants from 1,500 to 16,000 tonnes a year and an end-to-end model: turnkey EPC with fixed scope and price, financing of up to 70 %, remotely monitored operation and maintenance, a guaranteed offtake of 100 % of the product and management of environmental credit certification. It holds ISCC, ISCC PLUS and CGN certifications and ECHA registration. In Córdoba, together with Sadeco and the City Council, it is developing a plant of 16,000 tonnes a year in its first phase.

Frequently asked questions about the PPWR

What is the PPWR?

It is Regulation (EU) 2025/40 on packaging and packaging waste. It replaces Directive 94/62/EC and has applied directly throughout the EU since 12 August 2026.

How much recycled plastic will packaging need to contain in 2030?

30 % in PET contact-sensitive packaging and beverage bottles, 10 % in contact-sensitive packaging made from other plastics and 35 % in all other packaging, as an average per plant and year.

Does the PPWR replace Spain’s packaging law?

It does not repeal it, but it prevails over it. Royal Decree 1055/2022 remains in force where compatible, and MITECO is preparing a new royal decree.

Does chemical recycling count towards the targets?

The PPWR does not exclude it, but how it is counted depends on the calculation acts and sustainability criteria that the Commission must adopt before 31 December 2026, which are still pending.

Why is mechanical recycling not enough?

Because, apart from PET, there are no authorised mechanical technologies for returning post-consumer plastic to food contact. Chemical recycling produces polymer of virgin quality.

Do you generate or manage mixed plastic waste and want to turn it into the recycled content the PPWR will require? Talk to the Nantek team and we will assess the feasibility of your waste stream.

[107,105

post-11644","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","category-plastics","category-pyrolysis
<!-- This site is optimized with the Yoast SEO plugin v28.7 -
